Where a home is allowed

One district of eight allows a manufactured home by right. The residential district bars it.

Gates County's summary use table gives an answer for every use in every district, and the answers for a manufactured home are not the same across the county. This is the fact that decides whether a parcel works, and it has to be settled before anything else.

  • The eight districts are A-1 Agricultural, C-1 Commercial, I-1 Industrial, O&I Office and Institutional, PD Planned Development, R-1 Residential, RMF Multi-Family, and RMH-1 Residential Manufactured Home.
  • Manufactured Home, Double-wide: permitted in RMH-1; special use permit in A-1; allowed in a PD only if the master plan includes it; prohibited in R-1, C-1, I-1, O&I and RMF.
  • Manufactured Home, Single-wide: permitted in RMH-1; special use permit in A-1; prohibited in every other district, including PD.
  • Manufactured Home Park: permitted in RMH-1 only.
  • Mobile Home, meaning a home not built to the federal standard that took effect in 1976: prohibited in every district in the county's planning jurisdiction. Homes lawfully established before 16 June 2021 may remain under the nonconforming-use rules.
  • In RMH-1 a mobile home existing on 16 June 2021 may remain, but may only be replaced with a manufactured home, a modular home, or a site-built home.

The special use permit

In the farmland district the answer is a hearing, not a counter transaction.

A-1 is the district that covers rural land, and it is where most buyers looking for acreage will land. A special use permit there is a quasi-judicial process with a decision-maker and criteria, not a form.

  • The Board of Adjustment reviews and decides the application after a quasi-judicial public hearing, and may approve it, approve a revised version, deny it, or send it back to staff.
  • One of the criteria the board applies is that the use will not materially endanger the public health or safety if located where proposed.
  • The county publishes a special use permit bulletin alongside the application, which is the document to read before paying a fee.
  • A-1's dimensional table sets the minimum lot size as whatever the Gates County Health Department requires, but not less than one acre, with 175 feet of width, 40 feet of front setback, 20 feet at the sides and rear, and 35 feet of height.
  • A lawfully established lot of record created before 16 June 2021 that does not meet those dimensions may still be developed with one single-family home under the nonconformity rules.

What the home itself has to be

The appearance standards are written out, and the foundation rule has two exceptions.

Gates County's use-specific standards for a manufactured dwelling run to thirteen items and cite G.S. 160D-910. These are the requirements that change what a home costs to set up, and two of them turn on whether the land is owned or leased.

  • A continuous, permanent masonry foundation or masonry curtain wall of solid brick or brick veneer under the perimeter, unpierced except for required ventilation and access.
  • A home on leased land is exempt from that and may install a continuous vinyl curtain wall instead, which the ordinance attributes to G.S. 160D-910.
  • A single-wide on land that is owned may install a vinyl curtain wall, but has to install the masonry standard twelve years after the certificate of occupancy is issued if the home is still there.
  • Minimum roof pitch of three feet of vertical rise for every twelve feet of horizontal run, Class C or better roofing, and an eave projection of at least six inches which may include a gutter.
  • Exterior siding comparable to standard residential construction: vinyl or aluminum lap siding no shinier than flat white paint, cedar or other wood, stucco, or brick or stone.
  • The towing apparatus, wheels, axles and transporting lights have to be removed, and the home is oriented with its longest axis parallel to the lot frontage as far as practicable.
  • The street address number assigned by county emergency communications has to be displayed on the street-facing side in figures at least three inches tall that contrast with their background.

The order

A zoning compliance permit comes before the building permit.

Two county offices are involved and they are not in the same building. Planning and Development is on NC 37 South; the Inspections Department is on Court Street in Gatesville.

  • A zoning compliance permit is required before a building permit is issued, and the ordinance allows the two to be issued at the same time.
  • A zoning compliance permit application includes a site sketch or plot plan showing the lot lines and the principal structures.
  • Applications for building, electrical, mechanical, plumbing, gas-piping and mobile home set-up are downloaded, signed and returned to the Inspections Department with the fee, by check or cash.
  • Inspection requests are made by phone once the permit is issued, always with a permit number or address and entry instructions. The county states they are not to be left on voicemail, and that the only same-day inspection is for an emergency electrical reconnection.
  • The minimum lot size in both RMH-1 and A-1 defers to the Gates County Health Department, so the septic answer can raise the lot size the zoning table starts from.
