Warren County Manufactured Home Starting Points

Warren County's zoning ordinance does something none of the counties published before it does: it puts a manufactured home - a mobile home in everyday words - on the same line of the use table as a stick-built house and a modular home, and it does not separate a single-wide from a double-wide. That one row is permitted by right in the Agricultural Residential, Residential Lakeside and Residential districts and in the Lakeside Group Camp district. Where a home is allowed

  • The districts are AR Agricultural Residential, RL Residential Lakeside, R Residential, GC Lakeside Group Camp, TC Lakeside Tent or Trailer Camping, LB Lakeside Business, NB Neighborhood Business, HB Heavy Business, LI Light Industrial and HI Heavy Industrial, with IOD, the Interstate 85 overlay, listed as its own column.
  • The single-family row is permitted by right in AR, RL, R and GC, needs a special use permit in TC, and is not allowed in IOD, LB, NB, HB, LI or HI.
  • A manufactured-mobile home park needs a special use permit in AR, RL and R and is not allowed in any other district. A manufactured home sales lot is a separate use, permitted in IOD, HB, LI and HI.
  • A temporary dwelling, which the ordinance defines as a manufactured home lived in for up to a year while a permanent house is built, needs a special use permit in AR, RL, R and TC and is permitted by right in GC.
  • AR is the district the ordinance describes as promoting a compatible mixture of agricultural, forestry, conservation and very low density residential uses. RL and R are the lake and residential districts, and the lake districts carry their own shoreline rules.

The lot

The minimum lot size is a water and septic question before it is a zoning question.

Table II-1 gives AR, RL and R three different minimum lot sizes each, and which one applies depends on how the house will get water and get rid of waste. Most county tables publish a single number. This one publishes three, and the difference between the largest and the smallest is half an acre.

  • On a well and a septic system: 30,000 square feet minimum, 100 feet of lot width, 200 feet of depth, and a density of 1.45 units per acre.
  • On public water with a septic system: 20,000 square feet, 100 feet of width, 150 feet of depth, 2.18 units per acre.
  • On public water and public sewer: 15,000 square feet, 80 feet of width, 125 feet of depth, 2.9 units per acre.
  • Setbacks in all three districts are 30 feet front, 10 feet side and 25 feet rear, with a maximum building height of 35 feet measured at the front elevation.
  • New residential development may not exceed 25 percent impervious surface per lot. Anything over 36 percent triggers the stormwater requirements in Section II-I.
  • For RL lots of record abutting Kerr Lake or Lake Gaston the 25-foot rear setback does not apply on the lake side. The ordinance's table note ties that exception to lots recorded before the ordinance took effect; the zoning permit form ties it to 6 September 2011. Both dates are recorded as they appear.

The order

Warren County publishes a one-page process document for vacant land, and it is more direct about sequence than most county sources. The first two steps happen before anyone applies for a permit at all.

  • Step one: confirm the property has an address in the county E-911 database. If it does not, apply for one through Planning, Zoning and Code Enforcement.
  • Step two: go to the county Environmental Health Department for a perc test, the soil test for a septic system, whether the use is residential or commercial.
  • The document states in capitals that moving a manufactured home to property before having an address assigned, the property tested for a septic system, and a zoning or development permit and building permit obtained is a violation of county regulations.
  • Step three: water and sewer. If the property is within 500 feet of a county water line the house must connect to the public water system; otherwise a well permit comes from Environmental Health, which is also where septic permits are issued.
  • The document adds that septic approval is not the final step before construction - a zoning permit and a building permit still have to follow.
  • Step four: the zoning permit from the Zoning Administrator. Step five: a building permit for any structure over 144 square feet, with buildings on bona fide farms the only exception.
  • Warrenton and Norlina have separate zoning authority inside their corporate limits and their one-mile extraterritorial jurisdictions, and require their own zoning permits for construction.

What this page could not settle

A second home on the same land is the open question here.

The ordinance carries a list of conditions attached to uses marked SU in the use table, and one of those entries is titled Dwelling, manufactured home (singlewide or doublewide). Its wording describes an accessory dwelling, and it does not match the by-right answer the table gives for the same words.

  • Section II.K states that the conditions it lists apply only to the districts where Table II-2 shows SU for that use. For the single-family row that is the TC camping district alone.
  • The Section II.K entry for a manufactured home reads that this type of dwelling is permitted as an accessory use to the principal use of the property, for the owner or a facility caretaker, and that no more than one such dwelling is permitted for every ten acres.
  • The entry titled Dwelling, single family carries exactly the same two conditions, which is what suggests both are written for a second home on a parcel rather than the first.
  • Nothing read here settles whether the one-per-ten-acres limit reaches a manufactured home that is the only dwelling on a parcel in AR, RL or R. That is a question for the Zoning Director, and it is the first thing to ask if the plan involves two homes on one piece of land.
  • No minimum roof pitch, siding standard, masonry foundation requirement, minimum home width or heated floor area for a manufactured home on its own lot was found in the ordinance. The underpinning and skirting requirement - in place within 90 days of set-up, in a material the county approves - appears inside the manufactured-mobile home park section, which governs park spaces.

Which district is this parcel in, and is it inside the Warrenton or Norlina extraterritorial jurisdiction rather than the county's?

Will this home be on well and septic, public water with septic, or public water and sewer - and which of the three minimum lot sizes does that put the parcel under?

Is the parcel within 500 feet of a county water line, which would require connecting to the public system?

Has an address been assigned in the county E-911 database, and has the soil been tested for a septic system?

Is the parcel a lot of record on or prior to 6 September 2011, and does the Kerr Lake or Lake Gaston rear-setback exception apply?

Will the driveway, home and any slab stay under the 25 percent impervious surface cap for this lot?

Is this home the only dwelling on the parcel, or a second one - and if a second, which of the ordinance's conditions the Zoning Director applies?

Does the parcel abut Interstate 85, which puts it in the Interstate Overlay District and its 50-foot setback and shared-driveway rules?

Which district a parcel is in was not determined for any parcel, and whether a parcel falls inside the Warrenton or Norlina extraterritorial jurisdiction rather than the county's was not determined either. Both are parcel-level answers and both decide everything else on this page.

Whether the Section II.K one-dwelling-per-ten-acres condition applies to a manufactured home that is the only dwelling on a parcel is UNKNOWN and is written on this page as a question, not as a requirement and not as an absence of one.

No minimum roof pitch, siding standard, masonry foundation, minimum width or heated floor area for a manufactured home on an individual lot was found in the ordinance. That is the absence of a requirement in the sections read, not a statement that none exists anywhere.
