It zones land only inside regulated districts, and only one of them, the Cullowhee Planning Area, lists manufactured homes. There, a manufactured home is allowed in four districts of eight: the three multi-family districts and SF-MH, Single Family Residential - Manufactured Home. The SF district, which allows a site-built house, does not allow one. The finding

No county-wide zoning. One area lists manufactured homes.

Section 1.4 says parts of the ordinance apply to all land outside the towns, and the parts that 'specifically address regulated districts shall apply only to those lands within the regulated districts.' Of those districts, only the Cullowhee Planning Area's use table names a manufactured home.

  • Cullowhee Planning Area: a manufactured home, Class A or Class B, is allowed in MFH, MFM and MFL, the three multi-family districts, and in SF-MH, Single Family Residential - Manufactured Home. Table 9.9 marks each 'Use Permitted, Subject to Additional Standards'.
  • Cashiers Commercial Area: its use table lists single-family detached homes and no manufactured home. The Planning Director decides uses the table does not list.
  • US 441 Gateway District: its use table lists no manufactured home, and Section 9.5.1 says the district's rules do not apply to a lot developed for one single-family dwelling without subdivision.
  • Everywhere else outside the towns: no district rule was found for a manufactured home on its own lot. The flood, hillside and park rules below still apply, and so do the county's ridge and watershed rules.

Adverse finding

In Cullowhee, the SF district does not allow a manufactured home.

  • Check the parcel's district on the Cullowhee Planning Area Zoning Map before you put money down on the land or the home.
  • A manufactured home park is allowed only in MFH, MFM and MFL, not in SF-MH.

Adverse finding

In Cullowhee, a masonry curtain wall and a minimum roof pitch.

Section 9.4.4 sets two classes. Each needs 'a continuous, permanent masonry curtain wall, unpierced except for ventilation and covered access', a landing at the main entrance 'no smaller than six feet by six feet', and the home placed so the main entrance faces the front of the lot.

  • Class A: two or more sections, built to the HUD standards, at least 24 feet wide as set up on the site, and a shingled roof rising at least 1 foot for every 4 feet. The tongue, axles, towing gear and lights come off before anyone moves in.
  • Class B: built after July 1, 1976, to the HUD standards, with a gable roof rising at least 3.5 feet for every 12 feet.
  • Ask the dealer for the roof pitch in writing. The ordinance lists no class for a flatter roof.
  • Ask whether masonry skirting is in the quote. It is often a separate trade and a separate price.

Adverse finding

In a flood hazard area, 2 feet above the base flood.

Section 5.6 says a new or replacement manufactured home must be elevated to the regulatory flood protection elevation, which Article XI defines as the base flood elevation plus 2 feet. Where no base flood elevation has been set, it is at least 2 feet above the highest ground next to the home.

  • The home must be anchored to resist flotation, collapse and lateral movement.
  • If the chassis sits 36 inches or less above grade, it rests on reinforced piers or an engineered foundation. Above 36 inches, an engineer's certification is required.

Steep land

Lots averaging 35 percent slope fall under the hillside rules.

Section 5.8 applies to any building permit on property in the Mountain and Hillside Development District. A lot of record that is not on a protected ridge and whose average slope is under 35 percent is exempt.

  • On a regulated lot, a plot plan goes to the Planning Director for approval before a home is set.
  • The rules limit cut and fill and set driveway standards.
  • Ask the Planning Department to check the lot's average slope before you buy it.

The numbers

Lot size and setbacks in Cullowhee's SF-MH district.

These are the Section 9.4.3(h) standards for Single Family Residential - Manufactured Home.

  • Public water and sewer: at least 0.20 acres, and up to 5 homes an acre.
  • Public water or sewer, not both: at least 0.5 acres, and up to 2 homes an acre.
  • Neither: at least 1 acre, and 1 home an acre.
  • Lots at least 50 feet wide. Setbacks: front 20 feet, side 10, rear 10, or more where a stream buffer or landscaping rule needs more.
  • Height: 40 feet.

Parks and replacements

Two homes on one property make a park.

Section 6.3 sets three park levels. Level I is 'at least two manufactured homes but less than 12'.

  • Each home in a park is set 15 feet from the boundary and 30 feet from the next home, and has two parking spaces.
  • 'Manufactured homes shall be underpinned within 90 days of installation.'
  • In a regulated district, a nonconforming single-wide on its own lot may be replaced only by a Class B home no older and no smaller, in the same spot, within 180 days of the last day the old home was lived in. 'In all other situations, replacement shall be prohibited.'
  • The placement application says that if you are installing more than one home, talk to the county before you apply.

Its cover reads 'Adopted August 6th, 2019'; its text cites Chapter 160D, the state planning law in force from 2021, so later amendments are in it, but the document does not list them. The county's ordinance brief in the research record was used only to find the sections; no brief wording was carried onto this page.

The headline finding rests on Section 1.4, which limits district rules to the regulated districts, and on Table 9.9, the Cullowhee list of permitted uses, rows 'Manufactured homes, Class A', 'Manufactured home, Class B' and 'Manufactured home parks', read from the rendered table pages so each letter sits under its district. The Cashiers Commercial Area table (Table 9.1) and the US 441 Gateway District table were read for a manufactured-home row and have none.

The Class A and Class B standards are Section 9.4.4, items 10 and 11; the definitions of Manufactured Home, Class A and Class B are in Article XI. The Class A roof is written as 'one foot for each four feet of horizontal rise (1:4)'. The SF-MH lot, density and setback numbers are Section 9.4.3(h).

The park rules are Section 6.3. Its jurisdiction paragraph, 6.3.2(a), reads 'within the planning jurisdiction of any incorporated municipalities', which does not match the rest of the ordinance's county-wide reach; ask the county where it applies.
