  • No county district map, no minimum width, no minimum roof pitch, no masonry skirting requirement and no age cutoff was found in the county sources named on this page.
  • Franklin and Highlands are separate. The county's own mobile home application asks: 'If Inside the City Limits of Franklin or Highlands, do you have a Zoning Certificate?'
  • A private subdivision's restrictive covenants can bar a mobile home on a lot the county does not regulate at all. Read the deed and the covenants before you buy.

  • The report must carry the owner's name, the location of the home, and the name, title and signature of the person who ran the test, with the readings.
  • It can be faxed in, brought to the office, or handed to the inspector at the inspection. The memo says results will not be taken by telephone or word of mouth.
  • This is a real line item. Ask the set-up contractor, in writing, whether the test is in the quote and who orders it.
  • The packet also says: 'If Footers, We Need To Look At Before They Are Poured.' A poured footing that is already covered is a footing the inspector did not see.

Adverse finding

Your septic permit is not a site plan.

A notice in the packet, in capitals: 'AS OF FEBRUARY 1, 2003 A SITE PLAN WILL BE REQUIRED TO OBTAIN A PERMIT FOR NEW CONSTRUCTION INCLUDING MOBILE HOMES AND MODULAR HOMES. YOUR SEPTIC/WELL PERMIT IS NOT ACCEPTABLE AS A SITE PLAN.'

  • The site plan has to show lot lines, elevation above sea level, and all streams or bodies of water.
  • It has to show existing and proposed structures, driveways, wells and the septic system.
  • It has to show the distance from the structure to the well and the septic: 'no less than 25' from well, no less than 5' from any part of the septic system including the drain lines.'
  • The 9-1-1 office asks for a drawing of the home and the driveway as well, and points you at the county parcel viewer at gis.maconnc.org to make it.

Adverse finding

In a flood hazard area, the base flood elevation plus 2 feet.

The Flood Damage Prevention Ordinance defines the Regulatory Flood Protection Elevation as 'the Base Flood Elevation plus the Freeboard. In Special Flood Hazard Areas, this elevation shall be the BFE plus two (2) feet of freeboard.' Article 5, Section B(3)(a) applies it to new and replacement manufactured homes.

  • The reference level is the bottom of the lowest horizontal structural member of the lowest floor, not the floor surface.
  • The home is anchored to resist flotation, collapse and lateral movement, either by a certified engineered foundation system or under the state's Regulations for Manufactured Homes.
  • If the elevation is met with the chassis 36 inches or less above the grade at the site, the chassis rests on reinforced piers or an engineered foundation.
  • 'When the elevation of the chassis is above thirty-six (36) inches in height, an engineering certification is required.' That is an engineer's fee nobody quotes by accident.
  • Skirting below the lowest floor becomes a flood enclosure: flood-resistant materials, no heating or cooling, and flood openings on at least two different sides totalling at least one square inch for every square foot enclosed, with the bottom of each opening no higher than one foot above grade.

Steps, decks and skirting

Cap blocks stop being acceptable at 3 feet by 3 feet.

The same 2002 memo sets the line for landings and decks, and the packet's set-up sheet sets the line for steps.

  • A landing no larger than 3 feet by 3 feet may sit on cap blocks, with penetrometer readings supplied for the landing supports.
  • Larger than that, the NC Residential Code footing sizes apply: 'cap blocks are not considered pre-cast concrete, and therefore are not acceptable for decks of this size.' A roof over it makes it a porch, and the code's porch footings apply.
  • Permanent steps at a minimum of two doors, in pressure treated wood, concrete or steel - 'Concrete (not stacked blocks)' - on a concrete base and not attached to the home.
  • Stairs at least 3 feet clear, risers no more than 8 1/4 inches, treads at least 9 inches, a handrail on open sides of stairs to a door or platform more than 30 inches up, and closed risers above three steps.
  • 'Do Not Underpin Until Final Inspections!!!' The skirting notice also asks for vents front, rear and sides, ground cover of asphalt paper or plastic sheeting, and the ground graded to run water away from the home.

The order of steps

What the application asks for before a permit is issued.

  • Parcel number and township, the power company, and the home's year, make, size, deck size, bedrooms, value and serial number.
  • Whether the home replaces a mobile home on the exact same site, whether the property is in a watershed, whether it is in a flood plain, and the elevation above sea level.
  • Set-up, electrical, plumbing, mechanical and gas contractors, each with a licence number.
  • The name the septic approval is in and the year it was approved; the name the well approval is in and the year it was drilled; or, on city sewer, the receipt for the tap fee.
  • Since May 1, 2005 the county cannot issue a permit without a current workers' compensation certificate on file, including for a subcontractor carrying their own policy.
  • Since May 1, 2005, an inspection must be requested by the person or company doing that work - the electrician requests the electrical inspection - 'THIS INCLUDES ROUGH-IN AND FINAL INSPECTION REQUESTS. NO EXCEPTIONS.'
  • The 9-1-1 office: 'The driveway must be cut in on the property before the address can be generated,' and 'The assigned address must be posted on your home or at your driveway before a Certificate of Occupancy can be issued.'

Moving dirt

Half an acre disturbed is the line for an erosion control plan.

The land disturbance permit application is in the same packet, and a pad, a driveway and a drain field add up faster than people expect.

  • 'Erosion Control Plans are required @ 21,780 sq. ft. (1/2 Acre) Disturbed.'
  • Ground cover: revegetate within 21 calendar days of completing any phase of grading.
  • Cut slopes 1.5:1, fill slopes 2:1. A land disturbance involving a slope steeper than 1:1, or 45 degrees, requires plans.
  • Road grade standards: 16 percent paved, 10 percent gravel, 6 percent grass. A mountain driveway that fails these is a driveway you pay to rebuild.
  • A North Carolina trout stream requires a 25-foot buffer zone, and a stream crossing requires a permit from the state.

Who pulls the permit

The state says the permit is the set-up contractor's responsibility.

Macon County includes a 1999 memo from the North Carolina Department of Insurance in the packet it hands out. It is about who is supposed to get the permit, and it is worth reading before you agree to 'go by the inspection department' yourself.

  • 'Since dealers and set-up contractors are licensed by the State to set-up manufactured homes, we consider permitting and all associated costs to be your direct responsibility unless specifically contracted otherwise in writing.'
  • 'Your license name and number should be on the permit for every home that you contract to set-up.'
  • The memo allows a homeowner to pick up the permit if they can supply the dealer's or set-up contractor's name and licence number, provided the permit comes before the home moves and the cost is not shifted to the buyer without a written agreement.
  • So: ask whose name goes on the permit, and ask whether the permit fee is in the price you were quoted.

What is not written down

The headline finding rests on the ordinance list itself, which names eighteen county ordinances and includes no zoning ordinance and no manufactured home ordinance.
